NONCOMPLIANCE INFORMATION REPORT
1. Manufacturer:
Nissan North America Inc., Smyrna, TN plant
2. Vehicles Potentially Involved:
Certain Model Year 2021 Nissan Rogue vehicles manufactured in the Smyrna, TN plant from
September 23, 2020 to April 20, 2021. Based on production records, this issue is unique to
Model Year 2021 Nissan Rogue vehicles manufactured during the timeframe that the seat
back frame handling error occurred.
The seat assemblies that contain the subject second row upper tether wires are unique to
the supplier (Toyo, TN) for MY2021 Rogue vehicles built at the Smyrna plant. As such, this
issue affects no other Nissan or INFINITI vehicles.

5. Description of the Noncompliance:
On certain Rogue vehicles, the second row upper tether wires may have a poor weld
connection to the seat back frame. During the welding process at the supplier (Toyo, TN)
the second row upper tether wires may have moved out of position, which can cause an
insufficient weld. When this condition occurs, the second row upper tether wires may not
conform to requirements defined in S6.3 Strength requirements for tether anchorages of
FMVSS No. 225; Child restraint anchorage systems.
The upper tether wire of the second row seat is part of the LATCH system that secures
child car seats. In this condition, a child seat may not be secured during a crash or sudden
stop, which can increase the risk of possible injury of a child occupant.
6. Basis for Determination of the Existence of a Noncompliance
April 19, 2021 – During a routine internal yard sort activity, a plant operator noticed an
abnormal fit while installing the seat back frame into the second row seat assembly fixture
at the Smyrna, TN plant. The operator notified the supervisor of the issue, and Nissan
began an investigation together with the supplier.
April 2021 through May 2021 – Nissan conducted a plant audit activity to determine the
scope of the issue. Out of 6,950 seat back assemblies checked, four (4) units—three (3) left
hand and one (1) right hand—were determined to contain a poor weld connection between
the seat back and upper tether wire.
During the supplier investigation, it was discovered that the clamping mechanisms on the
seat back fixture were slightly loose, allowing movement of the seat frame, which caused
the tether wires to be out of position during the welding operation.
June 2021 – Nissan conducted a safety assessment to determine whether the weld
condition conformed to the regulatory requirements for tether anchorages.
June 17, 2021 – Based upon confirmation that the subject condition affected compliance
with FMVSS No. 225, Nissan made a noncompliance determination.
Nissan is not aware of any incidents related to the subject condition.
7. Description of Corrective Action:
Nissan will notify all owners of potentially affected vehicles beginning July 30, 2021.
Dealers will be notified June 30, 2021. Dealers will visually inspect the back of the seat
frames to confirm the weld condition for all three (3) second row upper tether wires. If a
non-conforming weld is found, dealers will remove and replace the affected rear seat back.
We will not include a statement in the Part 577 owner notification concerning
reimbursement for the cost of obtaining a pre-notification remedy as the subject vehicles
are under warranty.

This notice is sent to you in accordance with the National Traffic and Motor Vehicle Safety Act. Nissan has
decided that certain 2021 Model Year Nissan Rogue vehicles fail to conform to Federal Motor Vehicle Standard
(FMVSS) number 225, “Child Restraint Anchorage Systems.” Our records indicate that you own or lease the
Nissan vehicle subject to this recall as identified by the VIN on the inside of this notice.

In certain Rogue vehicles, the second row top tether anchors may have an insufficient weld connection to the
seat back frame. The top tether anchors of the second row seat are part of the Lower Anchors and Tethers for
Children (LATCH) system that secures child car seats in your vehicle. In this condition, the second row top tether
anchors may bend or move when a pull force is applied and may not meet the regulatory requirements of
FMVSS No. 225. Because of the unintended movement of the anchor, a child seat may not be secured during a
crash or sudden stop, increasing the risk of possible injury to a child occupant.
What Nissan Will Do

Your Nissan dealer will inspect the LATCH top tether anchors and replace, if necessary, the second row rear seat
backs free of charge for parts and labor. The inspection should take less than one (1) hour to complete;
however, if seat replacement is necessary the repair could take up to three (3) hours. Your dealer may require
the vehicle for a longer period of time based upon the dealer’s work schedule.

your local Nissan dealer for immediate service before using the child seat. If you are not using a child seat,
you may contact your Nissan dealer at your earliest convenience in order to arrange an appointment to have
your vehicle inspected, and if necessary, repaired. Please bring this notice with you when you keep your service
appointment.

Nissan is committed to the safety and security of our customers and their passengers. Nissan has notified the National Highway Traffic Safety Administration (NHTSA) and Transport Canada that it is recalling certain MY2021 Nissan Rogue vehicles in the USA and Canada to inspect the upper tether wires of the Lower Anchors and Tethers for CHildren (LATCH) system and replace, if necessary, the second row rear seat backs.
Due to a supplier manufacturing concern that has since been corrected, the LATCH tether wires on the second row rear seat backs may have an insufficient weld condition to the seat back frame. In this condition, the second row upper tether wires may bend or move when a pull force is applied and may not meet the regulatory requirements of FMVSS No. 225. Because of the unintended movement of the wire, a child seat tether may unlatch from the seat back, increasing the risk of injury during a sudden stop or crash.
Affected vehicles are subject to stop sale and are either currently in dealer inventory or assigned and in transit to the dealer.

1. Verify campaign applicability using Service Comm or DBS National Service History – Open Campaign I.D. PC812.

• New vehicles in dealer inventory can also be identified using DBS (Sales-> Vehicle Inventory, and filter by Open Campaign).

• Please continue to check newly arriving inventory for campaign applicability.
2. Dealers must not sell, lease trade, rent or loan any vehicles in dealer inventory subject to this recall campaign until after the vehicle has been remedied.
3. Dealers should use NTB21-060 to correct any vehicles subject to this campaign.
4. Once remedied, dealers should submit the claim, using the claims coding provided, and release the vehicle.

It is the dealer’s responsibility to check Service Comm or DBS National Service History Open Campaign using the appropriate Campaign I.D. for the campaign status on each vehicle falling within the range of this voluntary safety recall campaign, which for any reason enters the service department. This includes vehicles purchased from private parties or presented by transient (tourist) owners and vehicles in dealer inventory. If a VIN subject to this recall campaign was part of a dealer trade, the letter associated with that VIN should be forwarded to the appropriate dealer for service completion.
