Nissan

) is recalling certain 2021 Rogue vehicles. The second-row upper tether wires may have been improperly welded to the seatback frame, preventing a child seat from being securely anchored. As such, these vehicles fail to comply with the requirements of Federal Motor Vehicle Safety Standard number 225, “Child Restraint Anchorage Systems.”
Remedy
Dealers will inspect and replace the rear seatbacks as necessary, free of charge. Owner notification letters were mailed July 30, 2021. Owners may contact Nissan
customer service at 1-800-867-7669. Nissan

is committed to the safety and security of our customers and their passengers. Nissan
has notified the National Highway Traffic Safety Administration (NHTSA) and Transport Canada that it is recalling certain MY2021 Nissan
Rogue vehicles in the USA and Canada to inspect the upper tether wires of the Lower Anchors and Tethers for Children (LATCH) system and replace, if necessary, the second row rear seat backs.
Due to a supplier manufacturing concern that has since been corrected, the LATCH tether wires on the second row rear seat backs may have an insufficient weld condition to the seat back frame. In this condition, the second row upper tether wires may bend or move when a pull force is applied and may not meet the regulatory requirements of FMVSS No. 225. Because of the unintended movement of the wire, a child seat tether may unlatch from the seat back, increasing the risk of injury during a sudden stop or crash.
Affected vehicles are subject to stop sale and are either currently in dealer inventory or assigned and in transit to the dealer.

Description of the Noncompliance:
On certain Rogue vehicles, the second row upper tether wires may have a poor weld connection to the seat back frame. During the welding process at the supplier (Toyo, TN) the second row upper tether wires may have moved out of position, which can cause an insufficient weld. When this condition occurs, the second row upper tether wires may not conform to requirements defined in S6.3 Strength requirements for tether anchorages of FMVSS No. 225; Child restraint anchorage systems.
The upper tether wire of the second row seat is part of the LATCH system that secures child car seats. In this condition, a child seat may not be secured during a crash or sudden stop, which can increase the risk of possible injury of a child occupant.
Basis for Determination of the Existence of a Noncompliance
April 19, 2021 – During a routine internal yard sort activity, a plant operator noticed an abnormal fit while installing the seat back frame into the second row seat assembly fixture at the Smyrna, TN plant. The operator notified the supervisor of the issue, and Nissan
began an investigation together with the supplier.
April 2021 through May 2021 – Nissan
conducted a plant audit activity to determine the scope of the issue. Out of 6,950 seat back assemblies checked, four (4) units—three (3) left hand and one (1) right hand—were determined to contain a poor weld connection between the seat back and upper tether wire.
During the supplier investigation, it was discovered that the clamping mechanisms on the seat back fixture were slightly loose, allowing movement of the seat frame, which caused the tether wires to be out of position during the welding operation.
June 2021 – Nissan
conducted a safety assessment to determine whether the weld condition conformed to the regulatory requirements for tether anchorages.
June 17, 2021 – Based upon confirmation that the subject condition affected compliance with FMVSS No. 225, Nissan
made a noncompliance determination.
Nissan
is not aware of any incidents related to the subject condition.
Description of Corrective Action:
Nissan
will notify all owners of potentially affected vehicles beginning July 30, 2021. Dealers will be notified June 30, 2021. Dealers will visually inspect the back of the seat frames to confirm the weld condition for all three (3) second row upper tether wires. If a non-conforming weld is found, dealers will remove and replace the affected rear seat back.
We will not include a statement in the Part 577 owner notification concerning reimbursement for the cost of obtaining a pre-notification remedy as the subject vehicles are under warranty.
